A multitude of emerging contaminants broadly known as “per- and polyfluoroalkyl substances," (PFAS) are of great concern for North Carolina regulators and the general public at large. The NC WW/GW Laboratory Certification Branch does not currently have the authority to certify for the parameter known as PFAS. This parameter must be added to certification rule 15A NCAC 02H .

The Coastal Resources Commission's floating structure policies do not specifically address Floating Upweller Systems (FLUPSYs) used in shellfish aquaculture operations. These amendments will allow the use of FLUPSYs to be sited in marinas and as platforms for shellfish cultivation and clarify how these structures may be sited in public trust waters.

Description:
The Environmental Management Commission proposes to amend 15A NCAC 02Q .0802, Gasoline Service Stations and Dispensing Facilities, to increase the annual gasoline throughput limit under which gasoline service stations and dispensing facilities are exempt from 15A NCAC 02Q .0500 requirements for purposes of Title V permitting. The limit ensures that a facility’s emissions remain below the major source thresholds of 100 tons per year (tpy) of volatile organic compounds (VOCs), 25 tpy of combined hazardous air pollutants (HAPs), and 10 tpy of each individual HAP. The limit is recalculated to reflect the increased presence of onboard refueling vapor recovery (ORVR) emissions control equipment in the light-duty gasoline vehicles refueling at these facilities.
