ASP President O-Gon Kwon rejects measures taken against ICC
On 11 June 2020 the Government of the United States announced new measures against the International Criminal Court (ICC). These measures are unprecedented. They undermine our common endeavor to fight impunity and to ensure accountability for mass atrocities. I deeply regret measures targeting Court officials, staff and their families.
The Court is independent and impartial. The ICC is a court of law. It operates in strict adherence to the provisions of the Rome Statute.
The Rome Statute system recognizes the primary jurisdiction of States to investigate and prosecute atrocity crimes. As a court of last resort, the ICC is complementary to national jurisdictions. This is a cornerstone of the Statute.
To further strengthen the Rome Statute system, the Assembly of States Parties and the Court have embarked on a wide-ranging review process. The aim is to ensure effective and efficient accountability for atrocity crimes.
I will convene an extraordinary meeting of the Bureau of the Assembly next week to consider how to renew our unwavering commitment to the Court.
I call upon the States Parties and all the stakeholders in the Rome Statute system to reiterate once more our relentless commitment to uphold and defend the principles and values enshrined in the Statute and to preserve its integrity undeterred by any measures and threats against the Court and its officials, staff and their families.

The Assembly of States Parties is the management oversight and legislative body of the ICC. It is comprised of representatives of States that have ratified or acceded to the Rome Statute. President Kwon was elected President of the Assembly for a three year mandate in December 2017.

El 11 de junio de 2020, el Gobierno de los Estados Unidos anunció nuevas medidas contra la Corte Penal Internacional (CPI). Estas medidas no tienen precedentes. Socavan nuestro esfuerzo común para combatir la impunidad y garantizar la responsabilidad por las atrocidades masivas. Lamento profundamente las medidas dirigidas a los funcionarios y el personal de la Corte y sus familias.
La Corte es independiente e imparcial. La CPI es una corte de justicia. Opera en estricta adherencia a las disposiciones del Estatuto de Roma.
El sistema del Estatuto de Roma reconoce la jurisdicción principal de los Estados para investigar y enjuiciar los crímenes atroces. Como corte de último recurso, la CPI es complementaria a las jurisdicciones nacionales. Esta es una piedra angular del Estatuto.
Para fortalecer aún más el sistema del Estatuto de Roma, la Asamblea de los Estados Partes y la Corte se han embarcado en un amplio proceso de revisión. El objetivo es garantizar una rendición de cuentas efectiva y eficiente por los crímenes atroces.
Convocaré una reunión extraordinaria de la Mesa de la Asamblea la próxima semana para considerar cómo renovar nuestro compromiso inquebrantable con la Corte.
Hago un llamado a los Estados Partes y a todas las partes interesadas en el sistema del Estatuto de Roma para reiterar una vez más nuestro compromiso incesante para sostener y defender los principios y valores consagrados en el Estatuto y preservar su integridad sin alteraciones por las medidas y amenazas contra la Corte y sus funcionarios, su personal y sus familias.

La Asamblea de los Estados Partes es el órgano legislativo y de supervisión de la Corte Penal Internacional. Está integrada por representantes de los Estados que han ratificado o se han adherido al Estatuto de Roma. El Presidente Kwon fue elegido Presidente de la Asamblea por un mandato de tres años en diciembre de 2017.

في 11 حزيران/يونيو 2020، أعلنت حكومة الولايات المتحدة الأميركية عن اجراءات جديدة ضد المحكمة الجنائية الدولية. ذلك مضر بالجهود المشتركة لمكافحة الافلات من العقاب وتأمين المساءلة عن الجرائم الخطيرة. آسف بشدة لهذه الإجراءات التي تستهدف مسؤولين وموظفين من المحكمة وعائلاتهم.
إنَّ هذه المحكمة هيئة قضائية مستقلة ومحايدة، لا تخرج أعمالها عن الإطار القانوني الذي وضعه نظام روما الأساسي، الذي نشأت بمقتضاه. وأحد أركان هذا النظام هو إقراره بالاختصاص الأولي للدول في التحقيق والمقاضاة في الجرائم الفظيعة. والمحكمة الجنائية الدولية هي محكمة الملاذ الأخير، تقوم بدورها مكملة للولايات القضائية الوطنية. هذه قاعدة أساسية في النظام.
من أجل تعزيز نظام روما، تعمل جمعية الدول الأطراف فيه مع المحكمة على عملية مراجعة واسعة، بهدف تأمين محاسبة فعالة عن الجرائم الخطيرة.
سوف أدعو إلى عقد اجتماع طارئ لمكتب الجمعية الأسبوع المقبل لنبحث في كيفية تجديد دعمنا الثابت للمحكمة.
كما أدعو الدول الأطراف وكل المعنيين بنظام روما الأساسي إلى التشديد مجدداً على التزامنا الراسخ بصون المبادئ والقيم التي كرَّسها نظام روما الأساسي وبالدفاع عنها، والعمل على بقاء النظام الأساسي محفوظاً، لا تردعنا في ذلك أي تهديدات تُساق ضد المحكمة ومسؤوليها وموظفيها وعائلاتهم.

جمعية الدول الأطراف هي هيئة الإشراف الإداري والهيئة التشريعية للمحكمة الجنائية الدولية. وهي تتألف من ممثلي الدول التي صدقت على نظام روما الأساسي أو انضمت إليه. تم انتخاب الرئيس كوون رئيسًا للجمعية في ديسمبر 2017 لفترة ولاية مدتها ثلاث سنوات.
